Nice Commerce reserves the right to be subject to the below defined Force Majeure conditions, which void SLA.

“Force Majeure Events” are events beyond Nice Commerce’s reasonable control, which include, but are not limited to, acts of God, acts of government, flood, fire, earthquake, civil unrest, acts of terror, strikes or labor problems, computer, internet, or telecommunications failures, delays or network intrusions, extreme high-order volume periods*, or denial of service and any other degradations of the Service caused by third parties.

*Extreme high volume periods can be defined as an order volume above 50% average monthly order volume that occurs without at least five (5) business days' notice prior to the extreme order volume event given by CLIENT to NICE COMMERCE LLC.
